Effective from 1 October 2026

Who this disclaimer is from: Piotr Kardas, trading as HealthySwitch.Me (a sole trader), of 167-169 Great Portland Street, 5th Floor, London W1W 5PF ("we", "us", "our", or "Piotr").

Who it is for: anyone who uses the website at healthyswitch.me (the "Website") or who books or takes part in our service (the "Service").

Name of this document: in our other documents, including our General Conditions of Service, this disclaimer is referred to as the "Clinical Disclaimer". Both names refer to this same document.

Please read this disclaimer carefully before you use the Website or the Service. It explains what the Service and the Website content are, what they are not, and the sensible steps to take with your own care team. Nothing in this disclaimer reduces the rights you have under law, and nothing in it is intended to discourage you from starting, continuing, or completing any treatment, medication, or advice recommended by your oncology team, GP, consultant, or any other qualified healthcare professional.

1. Definitions

In this disclaimer:

1.1 "the Service" means the one-to-one specialist exercise rehabilitation that Piotr provides to men living with, and beyond, prostate cancer. It is delivered in two ways: online, by live video call, across the United Kingdom; and in person, in your own home, as a home visit within London or Surrey, as described in our General Conditions of Service. It also includes any individual exercise plan that Piotr prepares for you. "The Service" has the same meaning as "the Services" in our General Conditions of Service.

1.2 "the Website" means healthyswitch.me and all pages, articles, videos, downloads, and other material published on it.

1.3 "content" means all information published on the Website or shared as part of the Service, including articles, guides, exercise descriptions, videos, and any information that refers to the NICE guideline on prostate cancer (NICE NG131).

1.4 "your care team" means your oncology team, GP, consultant, specialist nurse, and any other qualified healthcare professional responsible for your medical care.

1.5 "you" and "the client" means the individual using the Website or the Service.

1.6 "Exercise toolbox" means the set of exercise equipment that we sell, as described in our General Conditions of Service.

2. What the Service and the content are

2.1 The Service is specialist exercise rehabilitation. Piotr is a Prostate Cancer Exercise Specialist, Registered Clinical Exercise Physiologist, who designs and supervises tailored, progressive exercise for men with prostate cancer and survivors. The exercise draws on adapted methods including progressive resistance and weight training, Pilates, Tai Chi, and Qigong.

2.2 The content on the Website is general information about exercise, physical activity, and living with prostate cancer, published to help you understand the subject. It is written for a general audience and is not tailored to any individual's circumstances.

3. What the Service and the content are NOT

3.1 The content is general information; the Service is specialist exercise rehabilitation. Neither is a diagnosis of, or a treatment for, prostate cancer or any other health condition, symptom, or side effect, and neither replaces the advice, care, or treatment provided by your own healthcare team.

3.2 The Service and the content are not a substitute for the assessment, advice, diagnosis, monitoring, medication, or treatment provided by your own healthcare team. They are intended to sit alongside that care, not to replace any part of it.

3.3 Piotr is a Prostate Cancer Exercise Specialist, Registered Clinical Exercise Physiologist. He does not diagnose, prescribe, or advise on any medication or treatment, and the Service is not healthcare; those matters remain with your own healthcare team.

3.4 Where the content refers to the NICE guideline (NICE NG131) or to published research, it does so to provide general information about what those sources say. Any such reference describes the source; it is not a promise, prediction, or guarantee about your own health, and it is not personal medical advice.

3.5 You should not delay seeking, disregard, stop, or change any advice or treatment from your care team because of anything in the Service or on the Website. If anything in the Service or the content appears to conflict with advice from your care team, follow your care team and tell Piotr.

4. No healthcare or treatment relationship

4.1 Using the Website, reading the content, contacting us, booking a consultation, or taking part in the Service does not create a healthcare or treatment relationship of any kind between you and Piotr.

4.2 The relationship between you and Piotr is that of a client engaging a specialist exercise rehabilitation service, on the terms of our General Conditions of Service and this disclaimer.

5. Before you start: clearance and continuing your care

5.1 Please obtain written clearance from your GP or consultant before your first appointment or exercise plan. Your care team knows your history and current treatment, and their clearance helps make sure the Service is appropriate for you at this time. You will be asked to provide a copy of that written clearance (as a PDF or a clear smartphone photograph) before your first appointment takes place, or before Piotr begins preparing an exercise plan for you, and to provide a copy of your diagnosis letter before your initial consultation, as described in clause 4 of our General Conditions of Service.

5.2 Please keep your care team informed. Tell them that you are taking part in an exercise rehabilitation programme, and share with Piotr any relevant advice, restriction, or precaution they give you (for example, guidance following surgery, radiotherapy, hormone therapy, or a bone health assessment) so that your exercise can be adapted accordingly.

5.3 Please continue all treatment, medication, and appointments recommended by your care team. The Service is designed to support your wellbeing alongside that care, never in place of it.

6. Your responsibility to share accurate information

6.1 The safety and suitability of your exercise depends on the information you give us. You agree to provide honest, accurate, and complete information about your diagnosis, treatment, symptoms, medication, and general health, and to keep Piotr updated if any of this changes during your time with the Service. Health information you share with us is handled as described in our Privacy Policy, on the basis of your explicit consent.

6.2 Piotr relies on the information you provide and on the clearance and advice of your care team when planning and adapting your exercise. Piotr cannot be responsible for a risk that arises from information you did not share, or from advice from your care team that was not passed on.

7. During exercise: when to stop and seek advice

The sessions are planned and progressed carefully around how you are feeling. As with any physical activity, exercise carries ordinary and inherent risks even when it is carefully planned and supervised, so it is sensible to listen to your body. Please stop the activity and seek advice from your care team, your GP, or NHS 111 if, during or shortly after exercise, you notice any of the following:

  • chest pain, pressure, or tightness;
  • unusual or unexpected breathlessness;
  • dizziness, light-headedness, or feeling faint;
  • an irregular, racing, or pounding heartbeat;
  • new, unusual, or increasing pain, including bone, back, or joint pain;
  • sudden weakness, numbness, or loss of balance;
  • nausea, or feeling generally unwell in a way that is not normal for you.

If you are taking part in a live session when any of this happens, tell Piotr straight away so the session can be paused. If symptoms are severe, come on suddenly, or you are worried, call 999 or seek urgent medical help. For non-urgent concerns, contact your care team, your GP, or NHS 111. This list is a general guide and is not exhaustive; you know your own body, and you should seek advice whenever something does not feel right, whether or not it appears above.

Exercising on your own. If you follow an exercise plan, or use the equipment in an exercise toolbox, on your own between appointments, keep to the guidance Piotr has given you and to any instructions supplied by the equipment's manufacturer, and stop and seek advice in the same way. If a piece of equipment appears damaged or unsafe, stop using it and tell Piotr.

8. No guarantee of outcomes

8.1 Exercise affects each person differently, and your response depends on many factors that are outside Piotr's control, including your diagnosis, treatment, medical history, and how your body responds. For this reason we do not guarantee, promise, or warrant any particular result, outcome, level of improvement, or benefit from the Service or from following the content.

8.2 Any information about the general benefits of exercise describes what published guidance or research reports for groups of people; it is not a prediction or assurance about your own results.

9. Piotr's discretion to adapt, decline, or stop on safety grounds

9.1 Piotr may, acting reasonably and in the interests of your safety, adapt an exercise, decline to deliver a particular activity, pause a session, or decline or discontinue the Service. He may do so where, for example, he considers an activity unsafe or unsuitable for you at that time, where you have not obtained the clearance described in clause 5, where information needed to keep you safe has not been provided, or where continuing would be inconsistent with advice from your care team.

9.2 This discretion exists to protect your safety and is not a judgement about you. Where Piotr declines or stops the Service in these circumstances, any effect on fees, appointments, or bookings is dealt with under our General Conditions of Service.

10. The Website content

10.1 We take reasonable care to keep the content accurate and up to date, but knowledge about health and exercise develops over time, and the content is general in nature. We do not warrant that the content is complete, current, or suitable for your individual circumstances.

10.2 The Website may link to, or refer to, information published by third parties, such as the NHS, NICE, or cancer charities. We provide those references for convenience and general information only. We do not control third-party material and are not responsible for its content.

10.3 Any action you take on the basis of the general content, rather than on personal advice given to you within the Service or by your care team, is taken at your own discretion.

11. Not an emergency service

11.1 The Service and the Website are not an emergency service and are not monitored around the clock. Do not use them to seek help in a medical emergency.

11.2 If you have a medical emergency, or you are concerned about urgent symptoms, call 999 or attend your nearest A&E. For urgent but non-emergency concerns, contact your care team, your GP, or NHS 111.

12. Your rights, and the limits of our responsibility

12.1 Nothing in this disclaimer excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under the law of England and Wales.

12.2 Nothing in this disclaimer affects your statutory rights as a consumer, including your rights under the Consumer Rights Act 2015 that the Service will be performed with reasonable care and skill. This disclaimer is to be read together with our General Conditions of Service; where the two address the same matter, the General Conditions of Service set out how our responsibilities and any limits on them apply to the Service.

12.3 Subject to clauses 12.1 and 12.2, we are not responsible for any loss or harm that results from your use of the general content in a way that is contrary to this disclaimer, in particular from using the general content in place of personal advice from your care team or from Piotr.

13. Changes to this disclaimer

We may update this disclaimer from time to time to reflect changes in the law, in relevant guidance, or in how the Service is delivered, or to keep it accurate and current. If you are a current client and we make a material change, we will tell you using the contact details you gave us. The version in force when you booked continues to apply to that booking, unless the change is required by law or is in your favour. The version published on the Website carries the effective date shown at the top; please review it from time to time.

14. Governing law

This disclaimer, and any dispute or claim arising out of or in connection with it, is governed by the law of England and Wales. If you are a consumer resident in Scotland or Northern Ireland, you keep the benefit of any mandatory consumer protections of the law of the part of the United Kingdom where you live, and you may bring proceedings in the courts of that part; otherwise the courts of England and Wales have jurisdiction.
