These General Conditions of Service ("Terms") govern the supply of specialist exercise rehabilitation services, and of the exercise toolbox, by Piotr Kardas, a sole trader trading as HealthySwitch.Me, to you as a client. Please read them carefully before you book or pay. By booking the paid consultation, or by paying for anything the Practitioner offers you after it, you agree to these Terms.

These Terms are the main agreement between you and us. The following documents form part of this agreement and are referred to at the relevant points below: the Privacy Policy; the Health and Exercise Disclaimer (referred to in these Terms as the "Clinical Disclaimer"); the Refund and Rescheduling Policy; the Cooling-off Notice (your right to cancel); and the In-Person Sessions: Safety, Safeguarding and Chaperone Policy (referred to in these Terms as the "Safeguarding Policy"). Where those documents give more detail on a topic, they apply in addition to these Terms. Your use of the Website itself is governed separately by the Website Terms of Use.

Nothing in these Terms affects your statutory rights as a consumer under the law of England and Wales, including the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the Consumer Protection Act 1987, the UK GDPR and the Data Protection Act 2018, the Privacy and Electronic Communications Regulations (as amended by the Data (Use and Access) Act 2025), and the Equality Act 2010. Where anything in these Terms would conflict with a right you cannot lawfully be asked to give up, your statutory right prevails.

2. About us and how to contact us

2.1 The Services are provided, and the Toolbox is sold, by Piotr Kardas, trading as HealthySwitch.Me, a sole trader. Our correspondence address is 167-169 Great Portland Street, 5th Floor, London W1W 5PF.

2.2 You can contact us by email at contact@healthyswitch.me.

2.3 If we need to contact you, we will do so using the email address, telephone number, or messaging channel you gave us when booking or paying.

2.4 We hold professional and public liability insurance appropriate to the Services. [INSURER NAME + POLICY NO; confirm and reflect any insurer-mandated clauses before publication.]

3. The Services and their scope

3.1 We provide one-to-one specialist exercise rehabilitation for men living with prostate cancer and for survivors. The Services are delivered in two ways:

Any Home Visit is also subject to the Safeguarding Policy. An Exercise Plan is prepared by the Practitioner and delivered to you as described in clause 6.5.

3.2 The Practitioner is a Prostate Cancer Exercise Specialist, Registered Clinical Exercise Physiologist, who currently works within a world-leading NHS cancer centre. The Services draw on adapted exercise methods, including progressive resistance and weight training, alongside other movement approaches selected for the individual client.

3.3 The scope of the Services. The Services are specialist exercise rehabilitation. They are not a diagnosis of, or a treatment for, any health condition, and they do not replace the advice, care, or treatment provided by your own healthcare team. Working with the Practitioner does not create a healthcare or treatment relationship.

3.4 You continue your own healthcare. You should continue any treatment, medication, and monitoring prescribed by your own healthcare team, and continue to consult them about your condition. The Services are intended to sit alongside that care, not in place of it. Further detail is set out in the Clinical Disclaimer, which forms part of this agreement.

3.5 The Services depend on information you provide about your health. We rely on that information being accurate and complete (see clause 11).

4. Eligibility and pre-participation screening

4.1 Because the Services support men with a prostate cancer diagnosis, participation is subject to a screening process. This process protects your safety and is a condition of receiving the Services.

4.2 Before the Consultation. You are asked to provide a copy of your diagnosis letter before your initial Consultation.

4.3 Before your first Appointment or Exercise Plan. You are asked to provide written clearance from your GP or consultant confirming that you are considered suitable to take part in a supervised exercise rehabilitation programme, before your first Appointment takes place, or before the Practitioner begins preparing an Exercise Plan for you, whichever comes first. Clearance you have already given covers later Follow-ons, but please tell us if your health or treatment changes, and we may then ask you for updated clearance.

4.4 How Screening Documents are supplied. After booking, we will contact you through the post-booking confirmation channel (for example email, text message, or WhatsApp) to request the Screening Documents. You may supply them as a PDF or as a clear photograph taken on a smartphone. The handling of these documents, which contain health information, is explained in the Privacy Policy; we process them on the basis of your explicit consent.

4.5 If Screening Documents are not provided. We may be unable to proceed with the Consultation, an Appointment, or an Exercise Plan until the relevant Screening Document has been received. If required Screening Documents are not provided within a reasonable time, or if their content means it would not be safe or appropriate to proceed, we may decline to deliver the affected Services and clause 13 (refusal, suspension, and termination) and the Refund and Rescheduling Policy will apply.

5. The paid Consultation

5.1 The paid fifteen-minute video Consultation is the single paid entry point to the Services. It is a paid Service and is not offered without charge.

5.2 The Consultation fee is £65.

5.3 The Consultation fee is not refundable once the Consultation has taken place. Because you book at a distance, you have a fourteen-day right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013. If you ask us to deliver the Consultation within those fourteen days, and acknowledge that you will lose the right to cancel once it has been delivered, that right ends when the Consultation has been delivered. Until then the right to cancel stands in full, and clause 9 and the Cooling-off Notice explain how to use it. The Consultation fee is not credited against the price of any Follow-on.

5.4 The Consultation is booked and paid for through the Website. A contract for the Consultation is formed when we confirm your booking.

5.5 Your right to cancel the Consultation under the Cooling-off Period is explained in the Cooling-off Notice. Rescheduling and late cancellation of the Consultation are dealt with in clause 10.

6. Follow-ons after the Consultation

6.1 After the Consultation, where the Practitioner considers that it would suit you, he may offer you one or more Follow-ons. Follow-ons are not booked or bought on the Website. There are no packages, no subscription, and no automatic renewal: each Follow-on is a single, separate purchase that you choose to make, and you are under no obligation to buy one.

6.2 How a Follow-on is agreed and paid for. The Practitioner talks through with you what he is offering and, if you would like to go ahead, sends you a Payment Link. Before you pay, the Payment Link, and the message the Practitioner sends with it, tell you what you are buying, its total price (including any postage and packing for a Toolbox), and, for an Appointment, the date and time agreed with you. You pay the full price in advance through the Payment Link. For an Appointment, payment must reach us by 12 noon on the working day before it, the same deadline as for moving or cancelling it. If it has not reached us by then, the Appointment does not go ahead and the time held for you is released, with nothing to pay. A contract for a Follow-on is formed when we confirm your payment to you by email. Each Follow-on is a separate contract.

6.3 Online Appointment. A single fifty-five-minute one-to-one session with the Practitioner by video call, available anywhere in the United Kingdom. The price is from £135. The price for your Online Appointment is confirmed in the Payment Link before you pay.

6.4 Home Visit. A single one-to-one appointment with the Practitioner at your home, within London or Surrey. A Home Visit is priced individually, because the price depends on where you live and what you need. The price and the length of your Home Visit are confirmed in the Payment Link, or in the message sent with it, before you pay. A Home Visit is subject to the Safeguarding Policy.

6.5 Exercise Plan. An individual exercise plan that the Practitioner prepares for you. The price is from £65, and the price for your Exercise Plan is confirmed in the Payment Link before you pay. You choose how you receive it:

Whichever format you choose, an Exercise Plan is a Service: the contract is for the Practitioner's work in preparing a plan for you. Online Appointments or a Home Visit can be arranged alongside an Exercise Plan, so that the Practitioner can demonstrate the exercises and support you in keeping to the plan, but you do not have to buy them. The Clinical Disclaimer applies to your use of the plan.

6.6 Toolbox. The Toolbox is a set of exercise equipment, in a small, medium, or large size, plus £4.99 postage and packing. It is goods, not a Service. Clause 7 sets out the terms that apply to it.

6.7 Each Appointment stands alone. An Appointment takes place on the date and time agreed with you before you paid. Paying for one Appointment does not entitle you to any further Appointment.

6.8 After a Follow-on we may let you know that you can arrange another one. Any further Follow-on is a new, separate purchase that you choose to make. You are never enrolled in anything automatically.

7. The Toolbox (goods)

7.1 What the Toolbox is. The Toolbox is a set of standard exercise equipment that the Practitioner chooses and puts together. It comes in three sizes: small, £45; medium, £95; and large, £145; in each case plus postage and packing of £4.99. The Practitioner may adjust the contents of a set to suit you. Before you pay, the Payment Link, or the message sent with it, tells you which set you are buying and what it contains.

7.2 Postage and packing. Postage and packing costs £4.99 for each Toolbox we send to you. There is no postage and packing charge if the Practitioner hands the Toolbox to you at a Home Visit. Any charge is shown in the Payment Link before you pay, and the total price includes it. The Payment Link, or the message sent with it, also tells you how the Toolbox will be delivered.

7.3 Delivery. We deliver the Toolbox to the address in the United Kingdom that you give us. If you and the Practitioner agree, he may instead hand it to you in person at a Home Visit. We will tell you the expected delivery date before you pay. Unless we agree a different date or period with you, we will deliver without undue delay and in any event no later than thirty days after the contract is formed, as section 28 of the Consumer Rights Act 2015 requires. If we do not deliver on time, you have the rights that section 28 gives you, which can include treating the contract as at an end and receiving a full refund.

7.4 When the Toolbox becomes yours. The Toolbox remains at our risk until it comes into your physical possession, or that of a person you have named to receive it (other than a delivery company we arrange). It belongs to you once it has been delivered to you, because you will already have paid for it in full.

7.5 Your right to cancel a Toolbox order. You can cancel a Toolbox order, for any reason, at any time from when you pay until fourteen days after the day on which the Toolbox comes into your physical possession, or that of a person you have named. Clause 9.3 summarises how this works, and the Cooling-off Notice gives the full detail, including how to return the Toolbox and how your refund is calculated.

7.6 If the Toolbox is faulty or not as described. Under the Consumer Rights Act 2015, the Toolbox must be of satisfactory quality, fit for purpose, and as described. If it is not, you have legal rights, which include:

If a fault appears within six months of delivery, the law generally presumes it was present when the Toolbox was delivered, unless we can show otherwise. We pay the reasonable cost of returning a faulty Toolbox, or an item from it, to us. These rights are in addition to your right to cancel in clause 7.5.

7.7 Using the equipment safely. Please use the equipment only in the way the Practitioner has advised, and follow any instructions supplied by its manufacturer. The Clinical Disclaimer applies to your use of the equipment. If an item appears damaged or unsafe, stop using it and tell us. Nothing in this clause limits the liabilities preserved in clause 14.2.

8. Payment

8.1 Prices are stated in pounds sterling and include any applicable taxes.

8.2 Payment for the Consultation is taken at the time of booking through our payment provider's secure hosted checkout. Payment for a Follow-on is taken in full, in advance, through a Payment Link, which the Practitioner sends you after the Consultation. We do not store your card details; they are handled by our payment provider, Stripe, in accordance with applicable card-industry security standards. More detail on payment processing is in the Privacy Policy.

8.3 We may update our prices from time to time. Any price change applies to bookings and orders made after the change. It does not change the price of anything you have already paid for.

9. Your right to cancel (Cooling-off Period)

9.1 Because you buy at a distance, you have a statutory right to cancel within the fourteen-day Cooling-off Period. The full detail of this right, including how to exercise it, the model cancellation form, and what happens if you ask us to begin a Service sooner, is set out in the Cooling-off Notice, which forms part of this agreement.

9.2 Services. For the Consultation, an Appointment, or an Exercise Plan, the Cooling-off Period ends fourteen days after the day the contract is formed. In summary, and without limiting the Cooling-off Notice: if you ask us to begin delivering a Service during the Cooling-off Period and then cancel, you may be charged a proportionate amount for the Service actually provided up to the point you told us you were cancelling. You lose the right to cancel a Service only once it has been fully performed at your request and you acknowledged that this would be the case. An Exercise Plan is fully performed when the finished plan has been delivered to you, in the app or on paper.

9.3 The Toolbox. For a Toolbox, the Cooling-off Period ends fourteen days after the day on which the Toolbox comes into your physical possession, or that of a person you have named, and you may also cancel before it arrives. In summary, and without limiting the Cooling-off Notice: you must send the Toolbox back to us, or hand it back to the Practitioner if he agrees, within fourteen days after the day you tell us you are cancelling; you pay the direct cost of returning it, unless it is faulty or not as described; we refund the price you paid, including any postage and packing you paid, within fourteen days after the day we receive the Toolbox back or, if earlier, the day you give us evidence that you have sent it back; and we may reduce the refund to reflect any loss in value caused by handling the equipment more than was needed to see what it is, what it is like, and how it works.

9.4 Refunds arising from a valid cancellation under the Cooling-off Period are dealt with in the Cooling-off Notice and the Refund and Rescheduling Policy.

10. Rescheduling, late cancellation, and missed appointments

This clause should be read together with the Refund and Rescheduling Policy, which gives the full detail. If there is any conflict, the Refund and Rescheduling Policy prevails on these points.

The Consultation

10.1 You may reschedule or cancel your Consultation without charge provided you give us at least twenty-four hours' notice before the scheduled start time.

10.2 If you cancel or reschedule with less than twenty-four hours' notice, or do not attend, the Consultation is treated as delivered and the £65 fee is forfeited. This reflects the slot reserved for you that cannot reasonably be reallocated at short notice, and the amount forfeited does not exceed the fee for the Consultation itself.

Online Appointments and Home Visits

10.3 How to ask. A request to move or cancel an Appointment must reach us by 12 noon on the previous working day, working days being Monday to Saturday, and must be made in writing by email to contact@healthyswitch.me. Please say in your email whether you would like to move the Appointment or cancel it, and, if you would like to move it, propose suitable alternative times.

10.4 If your request reaches us in time, you may choose either to move the Appointment to a new date and time that we agree with you, at no extra charge, or to cancel it and receive a full refund. The new Appointment is fixed only once we have confirmed it. If we cannot agree a new date that suits you, you may cancel instead and receive a full refund.

10.5 Late requests and missed Appointments. An Appointment that you cancel or seek to move after the deadline in clause 10.3, or that you do not attend, may be treated as delivered, and its price is then not refunded. This reflects the time reserved for you, and for a Home Visit the travel arranged, which cannot reasonably be reallocated at short notice. The amount kept never exceeds the price you paid for that Appointment. The Refund and Rescheduling Policy explains when a late request counts as made in time, for example after a hospital admission.

10.6 Nothing in this clause affects your statutory cancellation rights under clause 9 and the Cooling-off Notice, or your rights if a Service is not performed with reasonable care and skill (clause 12).

11. Your responsibilities

11.1 You agree to:

11.2 The Services are provided to you personally and are not transferable to another person without our agreement.

11.3 You are responsible for deciding, in consultation with your own healthcare professionals, whether to take part. Taking part in exercise carries ordinary and inherent risks, and you take part voluntarily. This does not remove any liability we have for failing to take reasonable care and skill, or any of the liabilities preserved in clause 14.

12. Our responsibilities and standard of service

12.1 We will provide the Services with reasonable care and skill, as required by the Consumer Rights Act 2015. This duty cannot be excluded, and nothing in these Terms attempts to do so.

12.2 We will deliver the Services in a professional manner and within the compliant scope described in clause 3.

12.3 If a Service is not performed with reasonable care and skill, you have statutory remedies, which may include having the Service performed again or a price reduction. These remedies are explained further in the Refund and Rescheduling Policy.

12.4 The Toolbox must be of satisfactory quality, fit for purpose, and as described, as the Consumer Rights Act 2015 requires. Your rights if it is not are set out in clause 7.6.

13. Refusing, suspending, or ending the Services

13.1 We may decline to begin, suspend, or end the Services (in whole or in part) where:

13.2 Where we end or suspend Services under this clause, the consequences for fees already paid are dealt with in the Refund and Rescheduling Policy, and always subject to your statutory rights.

13.3 You may stop using the Services at any time. Your statutory cancellation and refund rights are unaffected by this clause.

14. Our liability to you

14.1 This clause sets out our entire liability to you in connection with the Services and the Toolbox. Please read it together with clauses 3, 7, and 12, and with the Clinical Disclaimer. Our liability in connection with the Website is addressed in the Website Terms of Use (see clause 14.5).

14.2 Liabilities we do not and cannot exclude. Nothing in these Terms excludes or limits our liability for:

14.3 Exclusion of indirect loss. Subject to clause 14.2, we are not liable for any loss that is indirect or consequential, or for any loss of income, loss of profit, loss of opportunity, or loss that was not reasonably foreseeable at the time the contract was formed.

14.4 Cap on liability. Subject to clause 14.2, our total liability to you in connection with the Services and the Toolbox, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, is limited to the total price you have paid to us for the Service, Services, or Toolbox giving rise to the claim.

14.5 The Website and its content are provided for general information only and are not a substitute for individual advice from your own healthcare professionals. The general-information nature of the Website content, and our limited liability for it, are addressed further in the Website Terms of Use and the Clinical Disclaimer.

15. Health information and the Clinical Disclaimer

15.1 The Clinical Disclaimer forms part of this agreement. It explains the boundaries of the Services, the importance of continuing the care provided by your own healthcare team, and the circumstances in which you should seek urgent help. By agreeing to these Terms, you confirm that you have read and understood the Clinical Disclaimer.

16. Your privacy

16.1 We process your personal information, including health information, in accordance with the Privacy Policy. The Privacy Policy explains what we collect, why, the lawful bases we rely on, how long we keep it, and your rights. For health information, including the Screening Documents, we rely on your explicit consent.

17. Recording

17.1 Neither you nor the Practitioner may audio-record or video-record any Consultation or Appointment without the other's prior written consent.

18. Complaints

18.1 If you are unhappy with any part of the Services or with a Toolbox, please tell us. Our Complaints Procedure explains how to raise a concern and the timescales within which we will acknowledge and respond to it. Raising a complaint does not affect your statutory rights.

19. Events beyond our control

19.1 We are not responsible for any delay in, or failure to perform, the Services, or to deliver a Toolbox, caused by an event beyond our reasonable control (for example illness of the Practitioner, serious weather, disruption to delivery services, or failure of a third-party platform). If such an event occurs, we will contact you as soon as reasonably possible and arrange to reschedule the affected Consultation or Appointment, or to deliver the Toolbox as soon as we reasonably can, or, where that is not reasonably possible, address the position in accordance with the Refund and Rescheduling Policy and your statutory rights. This clause does not reduce your rights under clause 7.3 if a Toolbox is not delivered on time.

20. General

20.1 Changes to these Terms. We may update these Terms from time to time, for example to reflect changes in the law or in how the Services operate. The version that applies to your booking or order is the version in force when you make it. We will publish the current version on the Website with its effective date. Material changes will not be applied retrospectively to anything you have already paid for.

20.2 The whole agreement. These Terms, together with the documents that form part of them (the Privacy Policy, the Clinical Disclaimer, the Refund and Rescheduling Policy, the Cooling-off Notice, and the Safeguarding Policy), form the agreement between you and us for the Services and the Toolbox. Your use of the Website is governed separately by the Website Terms of Use.

20.3 Severability. If any provision of these Terms is found to be unlawful or unenforceable, the rest of the Terms continue in force.

20.4 No waiver. If we do not insist that you perform any of your obligations, or delay in enforcing our rights, that does not waive our rights against you or mean that you do not have to comply.

20.5 Assignment. You may not transfer your rights or obligations under these Terms to anyone else without our agreement. The Services are personal to you.

20.6 Third parties. These Terms are between you and us. No other person has any right to enforce them under the Contracts (Rights of Third Parties) Act 1999.

21. Governing law and jurisdiction

21.1 These Terms, and any dispute or claim arising out of or in connection with them, the Services, or the Toolbox, are governed by the law of England and Wales.

21.2 The courts of England and Wales have jurisdiction to deal with any such dispute or claim. If you live in another part of the United Kingdom, you keep the benefit of any mandatory consumer protections that apply where you live, and you may be able to bring proceedings there.

22. How to contact us

22.1 For any question about these Terms, the Services, or the Toolbox, contact us by email at contact@healthyswitch.me. Our correspondence address is 167-169 Great Portland Street, 5th Floor, London W1W 5PF.

These Terms take effect from 1 October 2026.
