This notice explains your legal right to cancel when you book or buy from Piotr Kardas, a sole trader trading as HealthySwitch.Me ("we", "us", "our"). It applies to the paid fifteen-minute video consultation ("the Consultation") and to everything Piotr may offer you after it. That can be a single fifty-five-minute online appointment by video call ("an Online Appointment"), a single appointment at your home ("a Home Visit"), an individual exercise plan that Piotr prepares for you ("an Exercise Plan"), or the exercise toolbox, a set of exercise equipment ("a Toolbox"). Online Appointments and Home Visits are together "Appointments". The Consultation, Appointments, and Exercise Plans are services, together "the Services". A Toolbox is goods. It is written in plain English so that you can understand your rights before you book or buy and afterwards.

The Consultation is booked online through our website. Everything else is offered by Piotr after the Consultation, and you pay for it through a secure payment link that he sends you. In law, a contract made without meeting us in person is a "distance contract", and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 ("the Regulations") give you a right to cancel it within a set period, for any reason. Whether you book online from home, or pay through a payment link after speaking with us, including after meeting Piotr in person, you have the same fourteen-day right to cancel described in this notice. This notice sets out that right, how the fourteen-day period works, how starting your Services early affects it, how to send back a Toolbox, and exactly how to cancel. A ready-to-use cancellation form is provided in Section 8.

Nothing in this notice affects your other statutory rights as a consumer under the law of England and Wales, including the Consumer Rights Act 2015. Where anything here would conflict with a right you cannot lawfully be asked to give up, your statutory right prevails. This notice forms part of, and should be read alongside, our General Conditions of Service and our Refund and Rescheduling Policy.

1. What this notice covers

1.1 This notice covers every booking and order you make with us: the Consultation, each Online Appointment, each Home Visit, each Exercise Plan, and each Toolbox. Each one is a separate contract with its own fourteen-day cancellation period.

1.2 The Consultation is a paid service, and it is covered by the Regulations in the same way as everything you buy afterwards. Paying for the Consultation does not remove your right to cancel. Section 5 explains how that right works when a Consultation or an Appointment is scheduled to take place quickly.

1.3 This notice concerns your right to cancel under the Regulations. Separate arrangements for moving appointments, late cancellation of a booked appointment, and missed appointments are set out in our General Conditions of Service and our Refund and Rescheduling Policy. Those arrangements are additional to, and do not reduce, the statutory cancellation right described here.

2. Your right to cancel within fourteen days

2.1 You have the right to cancel your contract within fourteen days without giving any reason.

2.2 You do not need to explain why you are cancelling, and you will not be asked to. You do not have to have started the Services or opened a Toolbox, and you do not have to be dissatisfied. The right is yours to use for any reason, or none.

2.3 To cancel, you only need to tell us that you have decided to cancel, before the fourteen-day period ends. Section 7 explains how, and Section 8 provides a form you can use.

2.4 If you cancel in time, you are entitled to a refund, subject only to a proportionate charge for any Services you asked us to begin and that we delivered before we were informed of your cancellation, and, for a Toolbox, to the points in Section 10. Section 5 explains when a charge for Services can arise, and Sections 9 and 10 explain how and when refunds are paid.

3. When the fourteen days begin and end

3.1 The Services. For the Consultation, an Appointment, or an Exercise Plan, the cancellation period begins the day after the day on which the contract is made, and it runs for fourteen days. For the Consultation, the contract is made when your booking is confirmed after payment. For anything you pay for through a payment link, the contract is made when we confirm your payment to you by email.

3.2 For example, if your contract is made on the 1st of a month, the cancellation period begins on the 2nd and ends at the close of the 15th. You may cancel up to and including the last day of the period, even if it falls on a weekend or a public holiday.

3.3 A Toolbox. For a Toolbox, the cancellation period ends fourteen days after the day on which the Toolbox comes into your physical possession, or that of a person you have named to receive it (but not a delivery company). If a Toolbox arrives in more than one delivery, the fourteen days run from the day the last part arrives. You may also cancel at any time before the Toolbox arrives, from the moment you have paid.

3.4 Your confirmation email records the date your contract was made, so that you can always see when your cancellation period for the Services ends.

4. If we did not give you this information

4.1 If we failed to tell you about your right to cancel before you booked or bought, the cancellation period is extended. If we give you the required cancellation information within twelve months beginning with the first day of your original cancellation period, your right to cancel runs until fourteen days after you receive it. If we never provide that information, the right to cancel ends twelve months after the day the period would otherwise have ended. We provide this notice, and confirm your cancellation rights in your confirmation email, precisely so that you always have this information in a form you can keep.

5. Starting your Services within the fourteen days (your choice)

5.1 By law, we should not begin delivering your Services during the fourteen-day cancellation period unless you have expressly asked us to start sooner. Many clients prefer to begin promptly, so we give you a straightforward, honest way to make that choice.

5.2 How the choice appears when you book the Consultation.

5.3 How the choice appears for an Appointment or an Exercise Plan. Before you pay through the payment link, Piotr will tell you in writing whether the Appointment date you have agreed, or the time he needs to prepare your Exercise Plan, falls inside your fourteen-day cancellation period. If it does, you will be asked to confirm, in writing and before you pay, that you would like us to begin within the fourteen days. If you would rather not, you can choose an Appointment date more than two weeks away, or ask Piotr to start your Exercise Plan after the fourteen days have passed.

5.4 Moving to an earlier date. The same choice applies if you later move a Consultation or an Appointment to a date inside your fourteen-day cancellation period: we will ask you to confirm the same request before that earlier date is confirmed.

5.5 What you are agreeing to. By making the request, you confirm two things: first, that you would like your Consultation or Appointment to go ahead on the early date you have chosen, or Piotr to begin preparing your Exercise Plan, within the fourteen-day period; and second, that you understand you will still be able to cancel during those fourteen days, but that if you do cancel after we have begun, you will pay a proportionate amount for what has already been delivered, and that once your contract has been fully performed at your request you will lose the right to cancel it. For the Consultation or an Appointment, this means the right to cancel ends once it has taken place. For an Exercise Plan, it means the right to cancel ends once the finished plan has been delivered to you.

5.6 Your confirmation email (a record you can keep). After payment, we send you an email that restates, in a form you can save and refer back to: the early-start request you made, your acknowledgement that the right to cancel is lost once your contract has been fully performed, that a proportionate charge applies for anything delivered before a cancellation, the date you selected, your fourteen-day cancellation rights, and the date and time the email was sent. This email is the durable record the Regulations require for an early start, and it is sent in addition to the request you made before paying.

5.7 A Toolbox. There is no early-start choice for a Toolbox. We send it as soon as we reasonably can, and sending it or delivering it does not reduce your right to cancel.

6. How starting early affects your right to cancel

6.1 Asking us to start early does not take away your right to cancel. You keep the full fourteen-day right described in Section 2. It only means we may begin before the fourteen days have passed.

6.2 If you cancel after we have begun at your request, you will pay a proportionate amount for the Services actually delivered up to the time we are informed of your cancellation, worked out from the price you actually paid. For an Exercise Plan, this reflects the share of the work on your plan that Piotr had completed by that time. You are refunded the balance.

6.3 You lose the right to cancel a contract for Services only when all of the following are true: everything we agreed to deliver under that contract has been fully performed; performance began because you asked for it to begin within the fourteen days; and you acknowledged, before we began, that you would lose the right to cancel once the contract had been fully performed. The Consultation, or an Appointment, is fully performed once it has taken place. An Exercise Plan is fully performed once the finished plan has been delivered to you, in the app or on paper.

6.4 If we did not give you the cancellation information this notice contains, or did not send you the confirmation email described in Section 5.6, you will not be charged for any Services delivered during the cancellation period. This is your protection, and our commitment to getting the paperwork right.

7. How to cancel

7.1 To cancel within the fourteen-day period, tell us clearly that you have decided to cancel, before the period ends. A clear statement that you are cancelling is enough; you do not have to use any particular form of words.

7.2 You can tell us in any of these ways:

7.3 You do not have to use the model form; it is provided for your convenience. Any clear statement that you are cancelling will take effect.

7.4 To meet the deadline, it is enough that you send your cancellation before the fourteen-day period ends. We recommend keeping a copy of what you send and the date you send it. If you cancel by post, we encourage you also to email us, so that we can stop an upcoming Appointment or a delivery promptly. On receiving your cancellation we will acknowledge it by email.

7.5 If you cancel a Toolbox order, please also send the Toolbox back, as Section 10 explains.

8. Model cancellation form

Complete and return this form only if you wish to cancel the contract. You may copy the wording below into an email, or print, complete, and post it.

The Consultation, Appointments, and Exercise Plans are services, so for those you would keep "for the supply of the following service", describe what you booked, and give the date you ordered it. A Toolbox is goods, so for a Toolbox you would keep "contract of sale of the following goods", describe the Toolbox, and give the date you ordered it and, if it has arrived, the date you received it.

9. Refunds for the Services

9.1 If you cancel a Service within the fourteen-day period, we will refund the amount you paid, less any proportionate charge for Services delivered at your request before we were informed of your cancellation, as described in Section 6.

9.2 We will make the refund within fourteen days of the day on which we are informed of your decision to cancel.

9.3 We will refund you using the same payment method you used to pay, unless you agree otherwise. You will not pay any fee as a result of the refund.

9.4 The £65 Consultation fee is not refundable once the Consultation has taken place, and it is not credited toward the price of anything you buy afterwards. Until the Consultation has been delivered, your fourteen-day right to cancel it stands in full, as described in Sections 2 and 6, and any refund is calculated on the amount you actually paid.

9.5 Separate contractual arrangements for moving appointments, late cancellation, and missed appointments outside the statutory period are set out in our Refund and Rescheduling Policy. Those arrangements are additional to, and do not reduce, the statutory rights in this notice.

10. Cancelling a Toolbox: sending it back and your refund

10.1 Sending it back. If you cancel a Toolbox order after it has arrived, you must send the Toolbox back to us, without undue delay and in any event within fourteen days after the day on which you tell us you are cancelling. If Piotr agrees, you may instead hand it back to him, for example at a Home Visit. The return address is in the package and in the email confirming your order.

10.2 The cost of sending it back. You pay the direct cost of returning the Toolbox, unless it is faulty or not as described. Where the equipment cannot normally be returned by post because of its size or weight, we will tell you an estimate of the return cost before you pay for it.

10.3 What we refund. We refund the price you paid for the Toolbox, including any postage and packing you paid.

10.4 When we refund. We refund you without undue delay, and in any event within fourteen days after the day we receive the Toolbox back or, if earlier, the day you give us evidence that you have sent it back. If you cancel before the Toolbox has been sent to you, we refund you within fourteen days after the day you tell us. We refund you using the same payment method you used to pay, unless you agree otherwise, and you will not pay any fee as a result of the refund. If you cancel while the Toolbox is on its way, please refuse the delivery or send it back when it arrives, and we refund you as above.

10.5 Handling the equipment. You may handle and try the equipment as you would in a shop, to see what it is, what it is like, and how it works. If it has been handled more than that and has lost value as a result, we may reduce your refund by the amount of that loss. We will not make this reduction if we did not give you the cancellation information in this notice before you bought the Toolbox.

10.6 If a Toolbox is faulty or not as described, you also have separate rights under the Consumer Rights Act 2015, which apply whether or not you cancel. They are described in our General Conditions of Service and our Refund and Rescheduling Policy.
