This statement explains how Piotr Kardas, a sole trader trading as HealthySwitch.Me ("we", "us", "our"), sends marketing messages by email, when we are allowed to send them to you, and how you can stop receiving them at any time. It should be read alongside our Privacy Policy, which explains more fully how we handle your personal information and the rights you have over it.
We send marketing email only where the law allows it, and we make it simple to opt out whenever you wish. We do not need you to hold an account, log in, or contact us in order to unsubscribe.
The law that governs marketing email in the United Kingdom is the Privacy and Electronic Communications Regulations 2003 ("PECR"), read together with the UK General Data Protection Regulation ("UK GDPR") and the Data Protection Act 2018. This statement follows the Information Commissioner's Office ("ICO") guidance on electronic mail marketing.
1. The two lawful routes, kept separate
1.1 This statement covers the marketing email we send to individuals. There are two, and only two, lawful reasons on which we may send you such marketing email:
- Route A, consent. You have actively told us that you would like to receive our marketing email. This applies to people who are not yet clients, for example someone who signs up to hear from us through the Website.
- Route B, the soft opt-in. You are an existing customer who bought, or negotiated to buy, our service, we obtained your contact details from you during that sale or negotiation, we are only telling you about our own similar products and services, and you were offered a simple way to opt out both when we collected your details and in every message since.
1.2 We keep the people on each route on two distinct lists, and we record which route applies to you so that we apply that route's rules precisely. If a prospect who joined under Route A later becomes a client, the client rules apply from then on; but an opt-out you have already made is always kept, and a client on Route B is never treated as though they had given Route A consent.
1.3 Whichever route applies, you can withdraw at any time using the methods in section 6, and doing so is free and we act on it promptly.
2. Route A, consent (for people who are not yet clients)
2.1 If you are not a client and you would like to receive our marketing email, you can ask us to add you to our mailing list. We rely on your consent, given to the UK GDPR standard, which means it must be freely given, specific, informed, and an unambiguous positive action by you.
2.2 In practice this means:
- The opt-in box is never pre-ticked. You give consent by actively ticking a box or taking an equivalent clear positive step. If a box is left blank, we treat that as no consent, and we do not add you.
- The consent is separate. The marketing opt-in is presented on its own, apart from any other agreement such as our General Conditions of Service or a booking. Agreeing to buy a service, or accepting our terms, does not sign you up to marketing.
- The wording is plain. We tell you, in clear language, who is asking (Piotr Kardas, trading as HealthySwitch.Me), what you will receive, and that you can opt out at any time. We provide a link to our Privacy Policy at the point of sign-up.
- We use a single opt-in. Once you complete the positive opt-in step, you are subscribed; we do not require you to confirm a second time. We keep a record of the consent you gave (section 5).
2.3 We do not buy, rent, or use bought-in marketing lists, and we do not add people to the mailing list because they merely contacted us with a question. Consent under Route A comes only from your own active sign-up.
3. Route B, the soft opt-in (for people who bought, or negotiated to buy, our service)
3.1 If you are an existing customer who bought our service, or negotiated with us to buy it, we may send you marketing email about our own similar products and services under the PECR soft opt-in. We may rely on the soft opt-in only where all of the following are true:
(a) We obtained your contact details from you in the course of a sale, or the negotiation of a sale, of our service to you (for example, when you booked a consultation, or paid for an appointment, an exercise plan, or an exercise toolbox).
(b) We are marketing only our own similar products and services, meaning specialist exercise rehabilitation and directly related offerings of the kind you engaged us for, such as further appointments, an exercise plan, or the exercise toolbox. We do not use the soft opt-in to market unrelated products, and we do not pass your details to anyone else to market to you.
(c) You were given a simple, cost-free way to opt out at the time we collected your details.
(d) You are given the same simple way to opt out in every message we send.
3.2 If any of those conditions is not met for a given person, we do not send them marketing email under Route B. Where we are unsure, we treat the position conservatively and either seek consent under Route A or do not send.
3.3 The soft opt-in is a route we may use; it is not an obligation you owe us. You are entirely free to opt out, and we will act on that promptly (section 6).
4. What we send, and our current restrictions
4.1 Our marketing email may include occasional updates about our service, information articles, availability, and, after an appointment or an exercise plan, a gentle reminder that you may wish to arrange another. We aim to keep the volume low and the content useful.
4.2 We recognise that, because of the nature of our service, simply being on a mailing list with us can itself be sensitive, and that this is especially true of the client list. We treat both lists with the same care as the rest of your personal information: we do not target marketing, build audiences, segment you, or profile you based on health conditions, health history, or anything you may have shared about your health.
4.3 We do not sell your personal information, and we do not share your email address with other organisations for their own marketing.
5. Records of your consent and preferences
5.1 For Route A, we keep a record of the consent you gave, including when and how you opted in, so that we can show that consent was properly obtained.
5.2 For Route B, we keep a record that your details were obtained in the course of a sale or its negotiation, and that an opt-out was offered at collection.
5.3 We keep your email address and marketing preference for as long as you remain subscribed. Two years of inactivity is our internal trigger to review a marketing contact: where an address has been inactive for two years, we will either re-confirm your wish to hear from us or remove you. The same review prompts us to take a fresh view before relying on the soft opt-in for someone whose last dealing with us was some time ago, rather than assuming an old sale still supports a current message. Full retention detail is in our Privacy Policy.
6. How to unsubscribe at any time
6.1 Every marketing email we send contains a clear unsubscribe link. Selecting it removes you from the relevant list. Unsubscribing is:
- One click. A single action on the link in any message is enough. You do not have to explain why.
- Account-free. You do not need to hold an account, set a password, log in, or reply to us to opt out. The link works on its own.
- Free and prompt. Opting out costs nothing, and we act on it without undue delay.
6.2 You can also ask us to stop at any time by emailing us at privacy@healthyswitch.me. If you prefer, you may tell us to remove you when we collect your details, before any message is ever sent.
6.3 Opting out of marketing does not affect service messages we need to send you about a booking or purchase you have made (for example, an appointment confirmation or a payment receipt). Those are not marketing; they are part of providing the service you asked for.
7. Our do-not-contact (suppression) list
7.1 When you unsubscribe, we do not simply delete your address and risk adding it again later. Instead we place it on a do-not-contact list, sometimes called a suppression list. The sole purpose of this list is to make sure we do not email you marketing again after you have asked us to stop.
7.2 We keep the minimum information needed for that purpose, and we check new marketing sends against the do-not-contact list so that a past request to stop is always respected. If you later decide you would like to hear from us again, you are welcome to opt back in under Route A, and we will act on that clear new instruction.
8. Your data protection rights
8.1 Piotr Kardas, trading as HealthySwitch.Me, is the data controller for the personal information described here. The email address and preferences we hold for marketing are personal information, and your rights under the UK GDPR apply to them, including the right to be informed, the right of access, the rights to rectification and erasure, and the right to object to direct marketing. The right to object to direct marketing is absolute: if you object, we will stop.
8.2 How to exercise these rights, our lawful bases, our retention periods, and our full contact details are set out in our Privacy Policy.
9. Changes to this statement
9.1 We may update this statement from time to time, for example to reflect changes in the law or in how we operate. The date at the top shows when it was last revised. Any change applies from the date it is published; it does not retrospectively affect an opt-out you have already made.
10. How to contact us
10.1 If you have any question about this statement, about a message you have received, or about how we handle marketing preferences, you can email us at privacy@healthyswitch.me. Our correspondence address is 167-169 Great Portland Street, 5th Floor, London W1W 5PF.
10.2 You also have the right to complain to the Information Commissioner's Office (ICO), the UK's data protection and electronic marketing regulator, at ico.org.uk opens in a new window. We would, however, welcome the chance to put things right first.
This statement takes effect from 1 October 2026.
