This document explains how we would use a testimonial, photograph, or video that you choose to share with us, and how you give, limit, and withdraw your consent. It also explains, honestly, how we source the images used in our own marketing. It is written so that you can decide freely and with a full picture, and so that your choice is always yours to change.
The Services are provided by Piotr Kardas, trading as HealthySwitch.Me, a sole trader ("we", "us", "our"). Piotr Kardas is the data controller. "You" and "your" mean the individual who receives, or has received, the Services. "The Practitioner" means Piotr Kardas, a Prostate Cancer Exercise Specialist, Registered Clinical Exercise Physiologist. "Content" means any testimonial, written words, photograph, image, audio recording, or video that features you, your words, or your likeness. This document should be read alongside our Privacy Policy, our Clinical Disclaimer, and our General Conditions of Service ("the Terms"). It stands apart from the Terms, because the consent it describes is voluntary and is never part of the bargain for the Services (see Section 1).
Nothing in this document affects your statutory rights, including your rights under the UK GDPR and the Data Protection Act 2018, the Consumer Rights Act 2015, or the Equality Act 2010.
1. Consent is voluntary, and never a condition of the Services
1.1 Sharing a testimonial, photograph, or video is entirely your choice. It is not a condition of receiving the Services, it is not expected of you, and it does not affect the quality, price, or availability of anything we provide to you.
1.2 You do not need to give any reason for choosing not to share Content, and we do not ask you to explain a decision to decline. Declining has no consequence of any kind.
1.3 If you do choose to share Content, you may consent to some uses and not others, and you may change your mind at any time (see Section 8).
2. How we source the images in our own marketing
2.1 We want you to be able to trust what you see. The people shown in the photographs and videos used across our Website, social media, and advertising are, unless a caption clearly states otherwise, professional actors or models, stock photography, or images created with the help of artificial intelligence. They are illustrative. They are not necessarily clients, and they do not depict real clients or real sessions unless we say so and the person shown has given the consent described in this document.
2.2 We make this disclosure here, in our legal copy, rather than repeating it on every individual image or caption. Where an image does feature a real client who has consented, we will not present an illustrative image as if it were that client, and we will not present an actor, model, or artificially generated image in a way that misleads you about who it shows. In particular, we do not place an illustrative image alongside a genuine testimonial in a way that suggests it shows the person who gave it.
2.3 We take this approach precisely so that no client feels any pressure to appear in our marketing. The Services do not depend on real client images, because we do not rely on them.
3. Testimonials you give independently
3.1 This document governs Content that you share with us for us to publish or reuse. It is separate from a review or testimonial that you choose to give independently, for example a review you post yourself on an independent online reputation or review service, or words you send us of your own initiative without being asked.
3.2 Where you post a review on an independent review service, that service, and its own terms and privacy notice, govern how your review is displayed there. If we later wish to repeat or feature such a review in our own marketing, we will treat that as a new use and will seek your consent under this document first, and we will apply the honest-presentation and anonymisation standards in Sections 5 and 6.
3.3 Where you send us unsolicited words of thanks, we will not publish them as a testimonial without asking you first and obtaining your consent under this document.
4. What we would ask to use Content for, and where
4.1 If you choose to share Content, we will only use it for the specific purposes and on the specific channels that you agree to on the consent form in Section 9. We will not use it for any purpose, or on any channel, that you have not ticked.
4.2 The channels are set out separately so that you can choose each one on its own, for each type of Content (a written testimonial, a photograph, or a video). Consenting to one channel, or for one type of Content, does not consent to any other. The channels are:
- our Website (healthyswitch.me);
- our social media channels (the accounts we operate in our own name on social media platforms);
- our advertising and marketing materials (for example printed leaflets, online advertisements, and presentations).
We will tell you which social media platforms we are using at the time we ask for your consent, and your consent covers the accounts we operate in our own name on those platforms. We describe the channel rather than printing a list here because platforms change, and a printed list would go out of date; the platforms themselves are always named to you on the form you sign. If we later start using a platform that was not named to you when you signed, we will ask you again before your Content appears there. Your consent covers what you were told about, which is what makes it informed, and it is never widened without you. Your protection is Section 8: you can withdraw at any time, for any channel, with a single email.
4.3 We will not sell your Content, and we will not license it to unrelated third parties for their own marketing.
4.4 Your consent lasts until you withdraw it, and we review it with you at least every two years. There is no fixed expiry date: your consent continues until you tell us to stop. You can withdraw it at any time, for any reason, and without giving a reason, by sending one email to contact@healthyswitch.me. You do not need to use any particular form of words, and you do not need to complete a form. At least once every two years we will contact you to check that you are still content for us to use the Content. If you tell us to stop at that review, or we cannot reach you at the contact details you have given us, we treat the Content as we would on withdrawal under Section 8: we stop all further use and remove it from the materials we control, such as our Website and our social media channels, as soon as we reasonably can, subject to the same practical limit for copies already published or distributed.
4.5 So that we can lawfully display the Content itself, your consent includes your permission (in copyright terms, a non-exclusive, royalty-free licence) for us to use the Content for the specific purposes and on the specific channels you have ticked. This permission ends when your consent ends, that is, when you withdraw it under Section 8 or it comes to an end at a two-yearly review under Section 4.4, subject to the same practical limit for copies already published or distributed (Section 8.3). Copyright in a photograph or video usually belongs to the person who created it, and other people may appear in it. The consent form therefore asks you to confirm that the Content is yours to share, and that anyone else who created it, or who appears in it, has agreed to this use. We do not publish Content featuring a person who has not agreed.
4.6 Giving consent allows us to use the Content; it does not oblige us to. We may choose not to publish Content, or to stop using it, at any time, for example where its wording would not meet the advertising rules that apply to us or our own standards of presentation. A decision not to use Content is never a reflection on you.
5. Honest presentation, and health-related content
5.1 We publish Content only in a form that is truthful and that complies with the advertising rules that apply to us. This means a published testimonial is presented as one person's own experience, attributed as such, and not as a promise or a typical or guaranteed result for anyone else. We never pay for a testimonial, and we do not offer money, discounts, or any other incentive in exchange for one.
5.2 We do not publish, and we edit out, any wording that presents a personal experience as a promised outcome, or that suggests a specific health result is typical. We may, with your agreement, shorten or lightly edit Content for length, clarity, or to meet these rules, and we show you the edited version before it is published if you ask.
5.3 Because our work concerns men affected by prostate cancer, a testimonial may touch on your health. Any such wording is treated as described in Section 7. We do not publish unsupported or promotional health-outcome claims, and we describe the Services as specialist exercise rehabilitation, not as healthcare, diagnosis, or treatment.
5.4 We will keep a record that a published testimonial is genuine and that you gave it, together with a means of contacting you, as the advertising rules require. This record is held in line with our Privacy Policy and is not published.
6. How we attribute testimonials, and your name
6.1 By default, we publish testimonials without your full name. Unless you positively choose otherwise on the consent form, we do not publish your full name. We would ordinarily attribute a written testimonial in a less-identifying way, for example by a first name only, by initials, or by a general description such as "a client". A first name or similar detail may still identify you to people who know you, so this reduces, rather than removes, the chance of being identified.
6.2 You may choose a pseudonym. If you would prefer to be identified by a name that is not your own, you may give us one, and we will use that instead.
6.3 You may choose to be named. If you would like to be attributed by your first name, your full name, or in another way, you may tell us on the consent form. You can change this at any time.
6.4 We will not name, and will take care not to allow Content to identify, the world-leading NHS cancer centre within which the Practitioner works.
6.5 Where Content is a photograph or video, anonymity may not be possible if you are recognisable in it. We will make this clear to you before you consent to any image or video use, so that your choice is fully informed.
7. Your consent, and special-category data
7.1 Content that relates to your health, including a testimonial that mentions prostate cancer or your experience of rehabilitation, is special-category personal data under the UK GDPR. We rely on your explicit consent (Article 9(2)(a)) to use it, which is why this document asks for a clear, specific, and separate agreement rather than treating your general engagement with us as permission. The Article 6 lawful basis for this use is also your consent (Article 6(1)(a)), alongside the Article 9(2)(a) condition, as recorded against the publication of testimonials, photographs, and videos in the "Why we use your information" table in our Privacy Policy. If Content refers to, or would reveal, your health and you have not given the explicit consent asked for in Section 9, we do not use that Content at all, whatever else you have agreed to.
7.2 Your consent is freely given, specific to the purposes and channels you tick, and informed by this document. Giving it, limiting it, and withdrawing it are all equally easy, and none of them affects the Services.
7.3 We keep a record of what you consented to and when, so that we can honour your choices and stop promptly if you change your mind. How we hold and retain personal data, including consent records and testimonial evidence, is set out in our Privacy Policy.
7.4 Consent under this document can only be given by an adult with capacity to give it, about their own Content. We do not seek or publish testimonials on behalf of another person.
8. Withdrawing your consent
8.1 You can withdraw your consent at any time, in whole or in part, and you do not need to give a reason. You may withdraw consent for all uses, or for a single channel or a single item of Content, by contacting us using the details in Section 10.
8.2 When you withdraw your consent, we stop using the Content in any new materials, and we remove it from the materials we control, such as our Website and our social media accounts, as soon as we reasonably can. We will keep only the minimum record needed to show what you consented to, that you withdrew, and when. We keep this so that we can act on your withdrawal reliably and meet the record-keeping the advertising rules and data protection law require of us; that minimum record is held as described in our Privacy Policy and is not published.
8.3 We are honest about one limit. Where Content has already been published or distributed before you withdrew, for example an advertisement already in circulation, a post that others have already shared or saved, or printed material already produced, it may not be possible to recall or delete every copy that is already out in the world. We stop all further use and make reasonable efforts regarding material we control, but we cannot guarantee the removal of copies that are already outside our control.
8.4 Withdrawing your consent is not a criticism, causes us no difficulty, and has no effect on the Services you receive.
9. Consent form
This form is completed only if you choose to share Content. Every box below is optional and starts unticked. Leaving a box unticked means you do not consent to that use. You may tick as few or as many as you wish.

A consent given electronically, for example by completing and submitting this form online, has the same effect as a signature.
10. Contact, questions, and withdrawing consent
10.1 To withdraw your consent, send one email to contact@healthyswitch.me saying that you withdraw it. That is all it takes. You do not need a form, a reason, or any particular wording, and we will confirm when we have acted on it. The same contact details are used to ask a question about this document, to share Content, or to change how you are identified:
- Email: contact@healthyswitch.me
- Post: 167-169 Great Portland Street, 5th Floor, London W1W 5PF
10.2 You also have the right to complain to the Information Commissioner's Office (ICO) about how we handle your personal data. Our Privacy Policy explains how, and we would always welcome the chance to put things right first.
11. Changes to this document
11.1 We may update this document from time to time, for example to reflect a change in the channels we use or in the law. The version that applies to a consent you give is the version in force when you give it. We will publish the current version on the Website with its effective date, and any material change to how your existing Content is used will be made only within the scope you have already agreed, or with your fresh consent.
This document takes effect from 1 October 2026.
