Effective from 1 October 2026

These Website Terms of Use ("these Terms") govern your use of the website at healthyswitch.me ("the Website"). They are between you and Piotr Kardas, trading as HealthySwitch.Me, a sole trader established in England ("we", "us", "our").

By accessing or using the Website, you accept these Terms. If you do not accept them, please do not use the Website.

These Terms concern your use of the Website itself. They are separate from, and lighter than, the Terms of Service (General Conditions of Service) that apply when you book a consultation, or pay for anything Piotr offers you after it. If you book the Services, that separate agreement governs the Services, and these Terms continue to govern your use of the Website. Three further documents apply to the information you read here and are referred to below: the Health and Exercise Disclaimer (referred to in some of our other documents as the "Clinical Disclaimer"), the Privacy Policy, and the Cookie Policy. Where those documents give more detail, they apply in addition to these Terms and are not repeated here.

Nothing in these Terms affects your statutory rights as a consumer under the law of England and Wales, including the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, the UK GDPR and the Data Protection Act 2018, and the Equality Act 2010. Where anything in these Terms would conflict with a right you cannot lawfully be asked to give up, your statutory right prevails.

1. Who we are and how to contact us

1.1 The Website is operated by Piotr Kardas, trading as HealthySwitch.Me, a sole trader. Our correspondence address is 167-169 Great Portland Street, 5th Floor, London W1W 5PF.

1.2 You can contact us by email at contact@healthyswitch.me.

1.3 The Practitioner referred to on the Website is Piotr Kardas, a Prostate Cancer Exercise Specialist, Registered Clinical Exercise Physiologist.

2. The Website content is general information only

2.1 The Website provides general information about specialist exercise rehabilitation for men living with prostate cancer and for survivors, and about the Services we offer. It is published to inform and to help you decide whether to contact us.

2.2 The Website content is general information about specialist exercise rehabilitation. It is not healthcare, not a diagnosis, and not individual advice, and it is not a substitute for the care, advice, medication, or treatment provided by your GP, your oncology team, or any other healthcare professional. You should not rely on the Website content as the basis for any decision about your health.

2.3 The Website content is subject to the Health and Exercise Disclaimer. Before acting on anything you read on the Website, please read the Health and Exercise Disclaimer, which explains the boundaries of the information provided, the importance of continuing your own medical care, and the circumstances in which you should seek urgent medical help. The Health and Exercise Disclaimer applies to all Website content.

2.4 Where the Website refers to guidance, including the National Institute for Health and Care Excellence guideline NG131, it does so to provide general information about that guidance. Any reference to outcomes describes what such guidance or research reports in general terms. It is not a promise or prediction about your own results.

3. Accuracy and availability of the Website

3.1 We take reasonable care to keep the Website content accurate and up to date. However, we do not warrant or guarantee that the Website content is complete, accurate, current, or free from errors or omissions. Website content may be updated or corrected from time to time.

3.2 The Website is provided on an "as available" basis. We do not warrant or guarantee that the Website, or any part of it, will always be available, uninterrupted, timely, secure, or free from faults, viruses, or other harmful components. Access to the Website may be suspended, withdrawn, or restricted at any time, including for maintenance, updates, or reasons beyond our reasonable control.

3.3 The Website is hosted and served by third-party providers. We do not control, and are not responsible for, the performance or availability of those providers' systems, though we take reasonable care in choosing them.

3.4 It is your responsibility to make sure that your own equipment, software, and internet connection allow you to access the Website, and to use your own virus protection.

4. Permitted use of the Website

4.1 You may use the Website for your own personal, non-commercial use, and to find out about and contact us in connection with the Services.

4.2 You may view, download, and print individual pages of the Website for your own personal reference, provided you do not remove or alter any copyright, trade mark, or other proprietary notices.

4.3 Any other use requires our prior written permission.

5. Acceptable use

5.1 You must not use the Website:

5.2 We may restrict or withdraw your access to the Website if we reasonably consider that you have breached this clause 5. Some conduct that breaches this clause, such as gaining unauthorised access to systems or introducing malicious material, may also be a criminal offence. Where conduct is unlawful or criminal, we may report it to the relevant authorities and cooperate with them.

5.3 If the Website offers any feature that allows you to post or submit content, such as blog comments, any contribution you make must be lawful, must be your own, and must not give health or exercise advice to other readers. We may decline to publish, or may remove, any contribution at our discretion and without notice. Views posted by other users are their own; they are not ours, are not endorsed by us, and are not advice.

6. Intellectual property

6.1 We, or our licensors, own all intellectual property rights in the Website and in all material published on it, including the text, page copy, images, graphics, layout, design, logos, and the compiled information and structure. These rights are protected by copyright, trade mark, and other laws. All such rights are reserved.

6.2 Some images used on the Website are illustrative and depict models, actors, stock, or artificially generated persons rather than clients, unless a caption states otherwise.

6.3 The name "HealthySwitch.Me" and any associated logos are our marks. You may not use them without our prior written permission.

6.4 Except as set out in clause 4 (personal, non-commercial use), you may not copy, reproduce, republish, download, post, broadcast, transmit, adapt, or otherwise use any material on the Website without our prior written permission or that of the relevant rights holder. Nothing in these Terms transfers any intellectual property right to you.

6.5 If you believe any material on the Website infringes your rights, please contact us using the details in clause 1.

7. Links to other websites

7.1 Where the Website contains links to other websites or resources provided by third parties, those links are for your information only.

7.2 We have no control over the content of those websites or resources and are not responsible for them, for their availability, or for any loss or damage that may arise from your use of them. The inclusion of a link does not imply that we endorse the linked website or its content.

7.3 If you follow a link to any third-party website, you do so at your own risk and subject to that website's own terms and privacy arrangements.

7.4 You may link to the Website's home page, provided you do so in a way that is fair and lawful, does not damage our reputation or take advantage of it, and does not suggest any form of association, approval, or endorsement by us where none exists. You must not frame the Website on any other site. We may withdraw permission to link at any time.

8. Our liability for your use of the Website

8.1 This clause sets out our liability to you in connection with your use of the Website and the Website content. Please read it together with clause 2, the Health and Exercise Disclaimer, and, where you have booked the Services, the Terms of Service.

8.2 Liabilities we do not and cannot exclude. Nothing in these Terms excludes or limits our liability for:

8.3 General-information nature of the Website. Subject to clause 8.2, because the Website content is provided free of charge and for general information only, we do not accept liability for any loss or damage arising from your reliance on the Website content, or from any inaccuracy, error, or omission in it. If you wish to act on anything published on the Website, you should first consult your own healthcare professionals, as explained in clause 2 and the Health and Exercise Disclaimer.

8.4 Exclusion of indirect loss. Subject to clause 8.2, we are not liable for any loss that is indirect or consequential, or for any loss of income, loss of profit, loss of opportunity, loss of data, or loss that was not reasonably foreseeable, arising out of or in connection with your use of, or inability to use, the Website.

8.5 Use of the Website. Subject to clause 8.2, we are not liable for any loss or damage caused by a virus or other technologically harmful material that may infect your equipment through your use of the Website, or through your downloading of any content from it or from any website linked to it.

8.6 Subject to clause 8.2, and to the fullest extent permitted by the law of England and Wales, our total liability to you, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, arising out of or in connection with your use of the Website and the Website content, is limited in aggregate to one hundred pounds (£100). This reflects that the Website is provided free of charge and for general information only. If you have booked the Services, our liability in connection with the Services is governed instead by the Terms of Service, and this clause 8 does not increase or reduce that liability.

8.7 This clause does not affect your statutory rights as a consumer.

9. Your privacy

9.1 We process any personal information you provide through the Website in accordance with the Privacy Policy. The Privacy Policy explains what we collect, why, the lawful bases we rely on, how long we keep it, and your rights. Our use of cookies and similar technologies, and the choices you have about them, are explained in the Cookie Policy. Please read both alongside these Terms.

10. Changes to the Website and to these Terms

10.1 We may update, change, suspend, or withdraw all or any part of the Website at any time. Beyond the reasonable care described in clause 3.1, we are not obliged to update any particular content on the Website.

10.2 We may change these Terms from time to time, for example to reflect changes in the law or in how the Website operates. The version that applies is the version published on the Website when you access it. We will show the effective date of the current version at the top of this page.

10.3 We recommend that you check these Terms when you use the Website, so that you are aware of any changes. Continuing to use the Website after a change means you accept the updated Terms.

11. General

11.1 Severability. If any provision of these Terms is found to be unlawful or unenforceable, the rest of these Terms continue in force.

11.2 No waiver. If we do not insist that you comply with any of these Terms, or delay in enforcing our rights, that does not waive our rights against you.

11.3 Third parties. These Terms are between you and us. No other person has any right to enforce them under the Contracts (Rights of Third Parties) Act 1999.

11.4 The documents that apply alongside these Terms. These Terms should be read with the Health and Exercise Disclaimer, the Privacy Policy, and the Cookie Policy, and, where you book the Services, with the Terms of Service, the Refund and Rescheduling Policy, and the Cooling-off Notice.

12. Governing law and jurisdiction

12.1 These Terms, and any dispute or claim arising out of or in connection with them or your use of the Website, are governed by the law of England and Wales.

12.2 The courts of England and Wales have jurisdiction to deal with any such dispute or claim. If you live in another part of the United Kingdom, you keep the benefit of any mandatory consumer protections that apply where you live, and you may be able to bring proceedings there.

13. How to contact us

13.1 For any question about these Terms or the Website, contact us by email at contact@healthyswitch.me. Our correspondence address is 167-169 Great Portland Street, 5th Floor, London W1W 5PF.

These Terms take effect from 1 October 2026.
